01Acceptance of Terms
By downloading, installing, or using NovelistAI ("the App"), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the App. M1 Insights Inc. ("M1 Labs," "we," "us," or "our") may update these Terms from time to time; your continued use after changes constitutes acceptance.
02Description of Service
NovelistAI is an AI-powered writing app for fiction authors. The App lets you: (a) capture text from books — by photographing a page for on-device OCR or by entering a book title and chapter — and receive an AI breakdown of narrative craft; (b) proofread extracted text; (c) complete guided writing exercises and receive AI critique; and (d) generate original scenes and combine them into longer novel projects with continuity ("Story Bible") support. Some features require an active Pro subscription.
03Accounts & Anonymous Sessions
You do not need to create a conventional account. The App automatically creates an anonymous session so we can secure requests to our backend and enforce fair-use limits. No email address, name, or password is requested. The anonymous identifier is a random value that we cannot use to identify you personally.
04AI-Generated Content
AI analysis, critique, and generated scenes are produced by automated systems and may be inaccurate, incomplete, or stylistically unexpected. They are provided for creative and educational purposes and are not professional writing, publishing, legal, or business advice. You are responsible for reviewing AI-generated content and for how you use it.
05User Content & Ownership
You retain ownership of the text, scenes, notes, and other content you create or input. By using the App, you grant us a limited license to process that content (including transmitting it to our service providers) solely to provide the features you request. AI-generated output produced at your request is yours to use, subject to these Terms and applicable law.
06Copyright & Fair Use
NovelistAI is designed for educational analysis of fiction craft and for your own writing. You are responsible for ensuring your use of any third-party copyrighted material complies with fair use/fair dealing and other applicable laws. Do not use the App to reproduce or distribute complete copyrighted works. Capture only reasonable excerpts for craft analysis.
07Subscriptions, Trials & Fair Use
Pro features are available through auto-renewing subscriptions (monthly and annual) purchased through Apple's App Store and governed by Apple's terms. Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period; you can manage or cancel them in your Apple ID settings. Pro use is subject to generous daily fair-use limits intended to prevent abuse; we may adjust these limits over time.
08iCloud Storage & Sync
Your library is stored locally on your device and, when iCloud is available, syncs to your private iCloud database. Synced data counts against your personal iCloud storage quota. Sync and deletion across devices depend on Apple's iCloud/CloudKit behavior, which we do not control.
09Acceptable Use
You agree not to: (a) use the App unlawfully or to generate infringing, defamatory, or harmful content; (b) attempt to reverse-engineer, decompile, or disassemble the App; (c) interfere with or disrupt the App or our backend; (d) circumvent fair-use limits or subscription controls; or (e) misrepresent your identity or affiliation.
10Intellectual Property
The App and its content — including the analysis prompts, interface design, and branding — are owned by M1 Insights Inc. ("M1 Labs," "we," "us," or "our") and protected by intellectual property laws. You retain rights to content you create within the App.
11Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App or its AI output will be uninterrupted, error-free, or accurate.
12Limitation of Liability
To the fullest extent permitted by law, M1 Insights Inc. ("M1 Labs," "we," "us," or "our") shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any claims arising from your use of captured or AI-generated content. Our total liability shall not exceed the amount you paid for the App in the twelve months preceding the claim.
13Termination
We may suspend or terminate your access to the App if you violate these Terms. Upon termination, your right to use the App ends; provisions that by their nature should survive termination remain in effect.
14Governing Law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Ontario.
15Changes to Terms
We may update these Terms. Material changes will be posted in the App or on our website, and your continued use after changes constitutes acceptance.
