01Acknowledgment Regarding Apple
You and M1 Insights Inc. acknowledge that these Terms of Service ("Terms") are concluded between you and M1 Insights Inc. only, and not with Apple. M1 Insights Inc., not Apple, is solely responsible for PromptCloak ("App") and the content thereof. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
02Subscription and In-App Purchases
PromptCloak requires a paid subscription for access to premium AI models and uncapped messaging. Payment will be charged to your Apple ID account at the confirmation of purchase. Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your App Store account settings after purchase.
03AI-Generated Content, Hallucinations, and No Professional Advice
PromptCloak uses Large Language Models (LLMs) to generate responses, including free-form chat and the Character Chat feature described below. You acknowledge and agree that: (a) AI models can "hallucinate" and produce inaccurate, incomplete, offensive, profane, emotionally charged, or fictional information, including content that is unexpected, contrary to your expectations, or contrary to factual reality; (b) the App does not provide medical, legal, financial, psychological, or any other form of professional advice — this applies equally to free-form chat and to in-character responses in Character Chat, which are works of fiction generated in response to your prompts; (c) you must not rely on any output from the App for critical decisions, and you should always consult a qualified professional; (d) M1 Insights Inc. does not author, curate, review, endorse, or verify any AI-generated output in real time, and is not responsible or liable for any actions you take based on the App's outputs.
04Character Chat and Fictional Roleplay
PromptCloak includes an optional "Character Chat" feature that lets you have long-form, user-directed roleplay conversations with fictional characters. By using Character Chat you acknowledge and agree that: (a) every character in Character Chat is entirely fictional — characters are not based on, and do not represent, any real person, living or deceased, and every character is 21 years of age or older by design; (b) responses in Character Chat are generated by third-party LLMs, not written or reviewed by M1 Insights Inc., and we do not curate, moderate in real time, or endorse what the model produces in response to your prompts — you are the author of the prompts and roleplay direction you provide, and the model is a tool that responds to your direction; (c) Character Chat is a creative-writing and entertainment tool, not a substitute for human relationships, companionship, mental-health care, or professional advice of any kind; (d) Character Chat is restricted to users who are at least 18 years old, and before first use you must affirmatively confirm your age in the App — this confirmation is stored only on your device, we do not collect or verify age data, and if you are under 18 you must not use Character Chat; (e) you are solely responsible for the direction you provide and the content that results; and (f) M1 Insights Inc. is a provider of software and access to third-party AI infrastructure and is not the author, editor, publisher, or "content provider" of any output generated in response to your prompts, to the maximum extent permitted by applicable law.
05Acceptable Use Policy
You agree not to use PromptCloak (including Character Chat, BYOK connections, and any other feature) to: (a) generate material that violates any local, state, or international laws; (b) generate, request, or attempt to elicit child sexual abuse material (CSAM), sexual or suggestive content involving minors in any form (including fictional, drawn, animated, or roleplayed minors), non-consensual sexual content, or content that promotes terrorism, violence, or self-harm; (c) roleplay, impersonate, defame, harass, or generate content depicting real identifiable people (living or deceased) in ways that could reasonably be considered defamatory, harassing, misleading, or infringing of their rights; (d) attempt to reframe, reroll, or instruct any Character Chat character as younger than 21, or in any way bypass the age safeguards built into the feature; (e) rely on Character Chat or any other feature for medical, legal, financial, or psychological advice — all such responses are fiction and are not professional advice; (f) reverse engineer, overload, or attempt to breach the security of our API infrastructure. M1 Insights Inc. reserves the right to ban your Public Key from our API if our automated abuse-detection systems flag your device for violating these terms, and to disable or remove the Character Chat feature at any time.
06Bring Your Own Key (BYOK) & Third-Party Providers
PromptCloak allows you to connect directly to third-party AI providers (such as OpenAI, Anthropic, and others) using your own API keys ("BYOK"). When using BYOK: (a) your requests are sent directly from your device to the third-party provider — M1 Insights Inc. does not intermediate, monitor, or log these requests; (b) your relationship with the third-party provider is governed solely by that provider's terms of service and privacy policy; (c) M1 Insights Inc. is not responsible for the availability, accuracy, content, security, or conduct of any third-party provider; (d) you are solely responsible for securing your API keys and for any charges incurred with third-party providers; (e) M1 Insights Inc. makes no warranties regarding the compatibility, reliability, or security of third-party provider APIs.
07Self-Hosted Software (Hermes Bridge)
PromptCloak provides optional integration with self-hosted software, including Hermes Bridge, which runs on your own hardware. By using Hermes Bridge or any self-hosted integration: (a) you acknowledge that this software runs entirely on your infrastructure and under your control — M1 Insights Inc. does not host, operate, or manage it; (b) you are solely responsible for the security, configuration, network exposure, and maintenance of your self-hosted environment, including but not limited to firewall rules, TLS configuration, access controls, and software updates; (c) M1 Insights Inc. is not liable for any security breaches, data loss, unauthorized access, or damages arising from the operation of self-hosted software, whether caused by misconfiguration, vulnerabilities in third-party dependencies, network exposure, or any other cause; (d) self-hosted software may depend on third-party open-source components (such as Hermes Agent by NousResearch) that are governed by their own licenses and terms — M1 Insights Inc. makes no warranties about such third-party software; (e) self-hosted software is provided "AS IS" without warranties of any kind, and you assume all risks associated with its installation and operation.
08Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, M1 INSIGHTS INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY; (C) UNAUTHORIZED ACCESS TO YOUR DEVICE; (D) YOUR USE OF BRING YOUR OWN KEY (BYOK) CONNECTIONS TO THIRD-PARTY PROVIDERS; (E) YOUR INSTALLATION, CONFIGURATION, OR OPERATION OF SELF-HOSTED SOFTWARE INCLUDING HERMES BRIDGE; OR (F) ANY AI-GENERATED CONTENT PRODUCED BY CHARACTER CHAT, FREE-FORM CHAT, OR ANY OTHER FEATURE OF THE APP, INCLUDING CONTENT THAT IS INACCURATE, OFFENSIVE, EMOTIONALLY DISTRESSING, OR CONTRARY TO YOUR EXPECTATIONS, WHETHER OR NOT ELICITED BY YOUR PROMPTS OR ROLEPLAY DIRECTION. YOU ACKNOWLEDGE THAT M1 INSIGHTS INC. IS A PROVIDER OF SOFTWARE AND ACCESS TO THIRD-PARTY LLM INFRASTRUCTURE AND IS NOT THE AUTHOR, EDITOR, PUBLISHER, OR CONTENT PROVIDER OF ANY OUTPUT GENERATED BY THIRD-PARTY AI MODELS. IN NO EVENT WILL M1 INSIGHTS INC.'S AGGREGATE LIABILITY FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS.
09Disclaimer of Warranties
The App, including all BYOK integrations and self-hosted software components, is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, whether express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the foregoing, M1 Insights Inc. does not warrant that self-hosted software will be secure, error-free, or compatible with your environment.
10Governing Law
These Terms shall be governed by the laws of the Province of Ontario, Canada, without respect to its conflict of laws principles. Any disputes shall be resolved in the courts of Ontario.
